Please read these terms carefully before using PropertyVault. By accessing our platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing and using PropertyVault, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. PropertyVault reserves the right to make changes to these Terms of Service at any time without notice.

2. Service Description

PropertyVault is a property intelligence platform designed to create verified, permanent digital records of property systems and conditions. The platform includes:

  • RoofVault: Verified roof condition records, storm documentation, and damage assessment
  • Property Vault: Digital storage and management of property records and inspection documents
  • Professional Features: Tools for contractors, realtors, and insurance professionals to view and manage shared property data

Services are provided on an "as is" and "as available" basis. PropertyVault makes no warranties about the continuous availability or functionality of the platform.

3. User Accounts

Account Responsibility

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to:

  • Provide accurate, complete, and current information during registration
  • Notify PropertyVault immediately of any unauthorized use of your account
  • Be responsible for all activities conducted through your account

Account Restrictions

You may not create accounts for purposes other than your own legitimate use or for unlawful purposes. You are prohibited from using the platform to collect or use property data for fraudulent or illegal purposes.

4. Subscription & Payment

Pricing

PropertyVault subscription pricing is displayed on our pricing page. All prices are subject to change at any time. We will provide notice of price changes via email.

Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize PropertyVault to charge your account for the subscription service. You are responsible for keeping your payment information current.

Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle unless you cancel. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Refunds

PropertyVault does not offer refunds for unused portions of subscription periods. However, we may offer refunds for billing errors or disputed charges in accordance with Stripe's policies.

5. Intellectual Property Rights

PropertyVault Ownership

The PropertyVault platform, including all software, features, content, and design elements, is owned by PropertyVault LLC. You are granted a limited, non-exclusive, non-transferable license to use the platform for your personal or business purposes as authorized by your subscription.

User-Generated Content

You retain ownership of all property data, photos, and documents you upload to PropertyVault ("Your Data"). By uploading Your Data, you grant PropertyVault a limited license to store, process, and display Your Data as necessary to provide the service. You may delete Your Data at any time.

6. Professional & Contractor Terms

Contractor Badge Requirements

Contractors applying for PropertyVault professional status must:

  • Maintain valid licensing in their state and specialty
  • Maintain liability insurance coverage
  • Complete background verification checks
  • Comply with PropertyVault inspection and documentation standards

Inspection Standards

All contractor inspections must meet PropertyVault standards, including mandatory photo documentation with geolocation and timestamping. False or misleading inspection data violates these terms and may result in account suspension.

Professional Conduct

Professional users must maintain ethical standards. Sharing confidential property data without authorization, falsifying inspection records, or harassing homeowners violates these terms and may result in legal action.

7. Limitation of Liability

To the fullest extent permitted by law, PropertyVault LLC and its officers, directors, employees, and agents are not liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or goodwill
  • Any damages arising from unauthorized access to your account or data
  • Service interruptions or data loss due to circumstances beyond our control

PropertyVault's total liability for any claim shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

8. Intelligence Scores & Data Estimates

PropertyVault provides three proprietary intelligence scores: Storm Damage Probability Score, Claim Readiness Score, and Deterioration Prediction Score. These scores are important to understand:

  • Informational estimates only. Intelligence scores are data-driven estimates generated by proprietary algorithms. They are provided for informational purposes only and do not constitute a warranty, guarantee, professional engineering assessment, or insurance appraisal.
  • Not a substitute for professional advice. Scores do not replace independent inspections, professional engineering evaluations, or licensed contractor assessments. Users should consult qualified professionals before making decisions about property repairs, insurance claims, or real estate transactions based on score data.
  • Accuracy improves over time. Scores are calculated using available property data, inspection records, industry-standard material lifespan data, and publicly available weather data. Score accuracy improves as more inspection data and historical outcomes become available in the system.
  • No guaranteed outcomes. A favorable score does not guarantee that a property will withstand a weather event, that an insurance claim will be approved, or that a roof will last for any specific period of time. A low score does not guarantee that damage has occurred or will occur.
  • No liability for score-based decisions. PropertyVault LLC is not liable for any decisions made, actions taken, or losses incurred based on intelligence scores or any other data provided through the platform.

9. Disclaimers

PropertyVault is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. PropertyVault does not warrant that:

  • The service will be uninterrupted or error-free
  • The service is free of viruses or other harmful components
  • Inspection data, property records, or intelligence scores are completely accurate or error-free
  • The platform will meet your specific requirements or expectations
  • Any data, scores, or estimates will produce any particular outcome

Users are responsible for verifying the accuracy of property data and should conduct independent inspections and seek professional advice for critical decisions regarding property condition, insurance claims, and real estate transactions.

10. Termination

PropertyVault may terminate your account for violation of these terms, payment failure, or any unlawful activity. Upon termination, you lose the right to use the platform, though you may request export of your property data within 30 days of termination.

11. Governing Law

These Terms of Service are governed by the laws of the State of Florida, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Volusia County, Florida.
